if you bought say a onkyo dvd player at Circuit city and noticed something
wrong with it after a few months and didn't want to go through repair, could
you buy the exact same player and keep it then return the defective one?
There are no serial numbers on the receipts. Does CC keep up with this or
would this work? I know it is not the most honest thing to do but if they
were a little better at returns with things under warranty it would not have
to happen. Just wondering if anyone out there that would know or possibly
works or worked at CC would know.

This is called fraud.
Circuit City, and any direct retailer for that matter, isn't under any
obligation to accept returns, even within the typical 30-day period,
that is a customary service that most direct retailers offer. Don't
abuse it.
Use the /manufacturers/ warranty, whatever that may be for your unit.
Typically 90 days parts/labor, 1 year parts, or 1 year parts/labor.
If you can't agree to the terms of the sale, DON'T BUY. Honesty /does/
matter in this life, even if you don't get caught.

The best deal is to simply avoid circuit city like the plague.
When I discovered that circuit city's rebate program was 50%
fraud (they only will rebate half what they promise), I vowed
never to return.
Personally, I would just do the swap. CC likes to screw ppl. over all the
time. Why not return the favor? Honesty is a good thing, but if the seller
isn't honest, why should the customer be?

I decided quite a long time ago to just not do business with CC after they
tried to charge me a 15% restocking fee on an unopened, still factory
sealed package (of blank CD media) that I had purchased 20 minutes prior.
I could have understood a restocking fee on an opened package, but this was
100% untouched and could be placed right back out on the sales floor. I
offered to "restock it for them" by walking over and putting it back where
I got it. It eventually took an argument with management who then warned me
that they would never do this for me again. They were foolish. I had spent
about $3000 in the store that year alone. I never went back.
Circuit City sucks.

really? What state are you from. In my state (MI) there is return.
Those stupid (no refund) since people put in the window mean nothing.

That is store policy that you are quoting. My statement was that there
is no compulsion for a store to offer a return policy -- however there
may be /some/ states where a return policy is a matter of law.
For the remainder of the country, CC isn't under an legal obligation to
offer a return policy -- don't abuse it, or it may be revoked, period.

That would just mean more business for their competitors. If Best Buy
changed their return policy to 90 days, like Wal-Mart, K-Mart, Target,
etc., I guarantee you that CC would be right behind them changing their
return policy to 90 days.

They dont seem to refuse much. And to be honest, just because CC claims
they don't accept it does not mean its leagal for them not to. I don't
recall any laws stating that they can refuse even software return. You
could probably force it on them with a lawyer. I wouldn't be so quick
to accept their position on what you can return.

Yeah, ok -- so?
The point was that the 30 policy that they apparently have is under
their terms. If people start abusing it and they lose $$ as a
consequence, it isn't unreasonable to expect them to cut the time or
eliminate altogether. A lot of smaller stores that can't afford return
fraud have done that.

Unless there is state law, I seriously doubt it. Further, the
government really has no business creating such law -- this is supposed
to be a free-market economy, such legal manipulation only hurt industry
and the customer in the long run.

It'd be fraud. That they do or don't keep up with it is irrelevant. That
and you'd be involving someone else, that's conspiracy to commit fraud.
Take your lumps, it's broken and warranty will cover it. If everyone
cheats the system there won't be a system that gives such leeway on
legitimate issues.
Another point to consider is model numbers aren't as stable as you might
think. They tend to repackage them ever-so-slightly between different
resellers and different times of the year. Mainly to avoid price shopping
between resellers and parts of the supply chain. Model xyz-123 might have
exactly the same innards are model xyz-321 but the slight changes to the
bezel or even just the box and part number is enough to make them
'different'. That might not be relevant in this particular case but it is
something to be aware of.
